Abstract
Will of John Cheeke, cooper, of West Mersea
Date of will: 19th December 1785
Date of death: unknown
Date of probate: 12th January 1786

Main bequests:
1. John Cheeke, nephew, who lives with testator, £5 to be paid after settlement of debts, funeral expenses, fees for the proving of the will and other incidental expenses.
2. Alice Cheeke, daughter of testator, receives the residue and remainder of the estate; aged 9 at the time of writing of the will, Alice to inherit when she attains the age of 21 or on her day of marriage, whichever occurs first. Settlement conditional on the marriage being consented to by the executors to the will.

The executors to sell the household goods and furniture after the decease of the testator and, together with sale proceeds of the stock-in-trade, to be invested in Government securities for the benefit of Alice. The dividends and interest to be applied towards the raising and education of Alice until she attains the age of 21 or day of marriage.

If Alice should die without issue before attaining the age of 21 or her day of marriage, then the residue and remainder of the estate and effects of the testator to be inherited by the nephew, John Cheeke.

John Braisted, oyster dredger, of West Mersea and Thomas Hawes, gentlamn, of West Mersea are appointed executors of the will and guardians of Alice during her minority.

1 In the Name of God Amen
2   I John Cheeke of West Mersea in the County of Essex
3   Cooper being of sound and disposing mind memory
4   and understanding thanks be given to almighty God
5   for the same, do make this my last Will and
6   Testament in manner following that is to say First
7   I commend my Soul into the hands of almighty
8   God My Creator hoping through the Merits of Jesus
9   Christ my Redeemer to obtain Remission of all my Sins
10   and my Body I commit to the Earth to be decently
11   buried at the discretion of my Executors herein after
12   named and as to the Temporal Estate wherewith it
13   hath pleased God to bless me I dispose thereof in the
14   following manner I give and bequeath unto my
15   Nephew John Cheeke who now lives with me the
16   sum of Five pounds to be paid him as soon as
17   conveniently may be after my decease and after
18   payment thereof and of my just debts Funeral
19   expenses the charges of proving and attending the
20   execution of this my Will and other incident
21   expenses I give and bequeath all the rest residue
22   and remainder of my personal estate and effects of
23   what nature or kind so ever and wheresoever unto
24   my only Child Alice Cheeke now an infant of the
25   age of Nine years and upwards to be paid delivered
26   or transferred to her at her age of twenty one years
27   or day of Marriage which shall first happen provided
28   she Marries with the Consent of my Executors herein
29   after named or of the Survivor of them and my will
30   and desire is that my said Executors or the Survivor
31   of them shall as soon as conveniently may be
32   after my decease make Sale of all or such part of
33   my Household Goods and Furniture as they or the
34   Survivor of them shall \First properly dispose of together with my stock in Trade and shall/ and will place lay out and
35   invest the Monies arising by Sale thereof and also
36   all other my Ready Monies and Book debts as soon
37   as the same can be got in and received either on
38   Real or Government Security or Securities in the
39   names of my said Executors or of the Survivor of
40   them my said Executors or of the Survivor of
41   them his Executors or administrators for the benefit
42   of my said daughter and shall and will pay and
43   apply the dividends Interest and proceed arising from
44   the whole of such the residue of my said personal
45   Estate and Effects for and towards the bringing up
46   Maintenance and Education of my said daughter

1   untill she shall attain the said age of twenty one
2   years or days of Marriage as aforesaid But my will
3   and meaning further is that if my said daughter
4   shall happen to die under the said age of twenty one
5   years without having lawful Issue of her body or before
6   her Marriage as aforesaid then and in such case I
7   give and bequeath all such residue and remainder
8   of my said personal Estate and Effects herein before
9   given to my said daughter unto my aforesaid
10   Nephew John Cheeke to and for his own Sole use and
11   disposal and Lastly I do hereby make nominate
12   constitute and appoint my Friends John Braisted of
13   west Mersea aforesaid oyster dredger and Thomas
14   Hawes of the same place Gentleman Executors of this
15   my <....> will and Guardians of the person and
16   Fortune of my said daughter during her Minority
17   and hereby revoking and making void all former
18   and other will and wills by me at any time heretofore
19   I publish and declare this to be my last will and
20   Testament In Witness whereof I the said John Cheeke
21   the Testator to this my last will and Testament
22   contained in two sheets of paper have to each
23   Sheet set my hand and Seal and my Seal to the
24   Label by which they are affixed together this nineteenth
25   day of december in the year of our Lord one thousand
26   seven hundred and eighty five [signature and seal of John Cheeke] signed
27   sealed published and declared by the said Testator
28   John Cheeke as and for his last will and Testament
29   in the presence of us who in his presence and at
30   his request have hereunto subscribed our names
31   as Witnesses [R.R. Newell] [John Hawes] /

32   This Will was proved at London the twelfth day
33   of January in the year of our Lord one thousand seven
34   hundred and eighty six before the Right Worshipful
35   Peter Calvert doctor of Laws Master Keeper or Commissary
36   of the Prerogative Court of Canterbury lawfully
37   constituted by the oaths of John Braisted and Thomas
38   Hawes the Executors named in the said Will to
39   whom administration was granted of all and Singular
40   the Goods Chattels and Credits of the said deceased
41   having been first sworn by Commission duly to admin[ister]
